Obligations, Agreements and Procedures

 

 

Object and Scope

1.1 At IB Wave, we are committed to providing our tutors and students with a respectful and safe educational space, in which their privacy and personal safety are guaranteed.

1.2 This document is the outcome of this commitment through the statement of the obligations of the student, adult responsible for the student, tutor and IB Wave, and the procedural description of the actions that must be carried out in inappropriate, disruptive or potentially illegal situations.

1.3 Without prejudice to the Security Policy set forth herein, the acts of the student, the adult responsible for the student, the tutor and IB Wave are subject to the legislation of the Kingdom of Spain and the Community of Madrid.

 

Context

2.1 The educational services offered by IB Wave will be carried out exclusively on-line, through Zoom or similar telematic platforms. Therefore, it will not be necessary to hold interviews or face-to-face meetings between the student and the tutor.

2.2 The on-line lessons will be private and individual, and will be carried out through a telematic meeting opened by the tutor, to which the student will connect, having previously been personally invited by the tutor via e-mail.

2.3 During the meeting, verbal messages, images and digital documents will be exchanged between the tutor and the student. Both the audio an the audio and the images shared between the tutor and the student i the meeting may be recorded.

2.4 IB Wave may revise the recordings of lessons, reserving the right to make them available to police or judicial institutions, when any illegal or illicit action can be seen in their content.

2.5 Communication with the student and the responsible adult will be made by telephone and via e-mail, using the telephone number and e-mail address provided on the registration form. However, the responsible adult may change or supplement these contact details.

2.6 Although it is not considered necessary, if the responsible adult approves it, an instant messaging service, such as WhatsApp, may be used to streamline communication between the student and the tutor. In any case, they will always be part of the messaging group, in addition to the student and the tutor, the student’s parent or legal guardian and a representative of IB Wave.

 

Obligations

 

Of the Student

3.1. Treat the tutors respectfully and fairly without discrimination based on gender, ethnicity, sexual preference, age, religion, or disability. Avoiding any type of disruptive action.

3.2 Do not show inappropriate images, videos or audios during classes.

3.3 Use appropriate language with the tutor.

3.4 Do not carry out demonstrations of a racist or xenophobic nature, also avoiding making any type of speech that could be considered a defence of violence.

3.5 Notify IB Wave, through the parents or legal guardian, of any incident arising with the tutor before, during or after the lesson.

3.6 Notify IB Wave, through the parents or legal guardian, if the tutor or a third party related to them exhibits inappropriate, illegal or illicit behaviour before, during or after the lesson.

3.7 Be aware that lessons are being recorded.

 

Of the Tutor

4.1. Treat the students respectfully and fairly without discrimination based on gender, ethnicity, sexual preference, age, religion, or disability. Avoiding at all times any abuse of their authority.

4.2. Create a comfortable space where students feel comfortable expressing their opinions and ideas.

4.3. Do not show inappropriate images, videos or audios during lessons.

4.4 Do not carry out demonstrations of a racist or xenophobic nature, also avoiding making any type of speech that could be considered a defence of violence.

4.5. Use professional and appropriate language with the student.

4.6 Notify IB Wave of any incident with the student before, during or after the lesson.

4.7 Notify IB Wave if the student or a third party related to them exhibits inappropriate, illegal or illicit behaviour before, during or after the lesson.

4.8 Be aware that lessons are being recorded.

4.9 Do not communicate with the student or add them to any social network, such as Instagram, TikTok, Snapchat or Facebook, among others.

4.10 Do not request any type of personal data from students.

 

Of IB Wave

 5.1. Guarantee that all tutors meet the appropriate standards, carrying out a rigorous selection process based on personal interviews and giving prominence to the values and pedagogical attitudes of the candidates.

5.2. Deal promptly with all claims/notifications of improper, illegal or illicit actions during or outside the lesson by the tutor or the student. 

5.3 Make the recordings of the lessons available to the competent authorities, if the student or the tutor denounces that an illegal or illicit activity has taken place during the lesson.

5.4 Treat the incidents arising between the tutors and the students or their responsible adults individually in order to guarantee the permanent well-being of all the parties involved.

5.5 Frequently evaluate and update the Security Policy contained in this document, with the aim of maintaining appropriate security, privacy and confidentiality standards.

 

Of the Responsible Adult: parents or legal guardian

6.1. Assume the full extent of the contractual relationship with IB Wave, when the student is a minor.

6.2 Check the security policy and ensure that the student is fully aware of it.

6.3 Assume responsibility for ensuring the student’s well-being during classes.

6.4 Notify IB Wave in case of any type of dispute between the student and the tutor before, during or after the lesson. Refrain from speaking again with the tutor, unless the reported situation turns out to be the result of an error or misunderstanding.

6.5 Notify IB Wave if the tutor or a third party exhibits inappropriate, illegal or illicit behaviour before, during or after the lesson. Refrain from speaking again with the tutor, unless the reported situation turns out to be the result of an error or misunderstanding.

6.6 Be aware that lessons given to the students are being recorded.

 

Agreements

7.1. All parties (tutors, students, responsible adults and IB Wave management) participating in IB Wave services are required to read and comply with the Security Policy materialised in this document.

7.2 Tutors who are reported for having seriously breached the obligations set forth in this document will be immediately relieved of their duties, and their actions will be investigated by IB Wave and/or the competent authorities.

7.3 Serious breach of their obligations by the student and/or responsible adult will cause the definitive suspension of the contracted lessons.

7.4 Cases of minor non-compliance, by the tutor or student/responsible adult, will be dealt with individually in the manner and time that the IB Wave management deems most appropriate.

7.5 Serious violations of this Security Policy that include, among others, illegal activity or serious discrimination, will be reported to the competent police and/or judicial institutions.

 

Procedures

Purpose and scope

8.1. The following sections describe the IB Wave Security Procedure. It is a series of actions that each party must execute in different cases of non-compliance with the Security Policy.

8.2 The purpose of the procedures is to provide a quick and clear course of action for all the parties involved, depending on the type of breach. 

8.3 Different actions are contemplated depending on the seriousness of the violation. Some will only require notification to IB Wave, while other more serious ones may require a direct report to the competent authorities.

8.4 IB Wave will not be responsible for the non-compliance by any of the parties of any of the actions detailed in this recommended procedure.

8.5 The adult responsible for the student is requested to report to IB Wave any bad practice by a tutor known to them, whether or not it appears on the list of disruptive situations set forth below.

 

If the Tutor is subjected to:

9.1. Inappropriate or abusive language or gestural behaviour in the lessons by the student or responsible adult.

9.1.1 In the event that the student or their responsible adult use inappropriate or abusive language or gestures, the tutor will ask the student, or the responsible adult, to stop their behaviour. If such behaviour persists, the tutor must end the telematics meeting and report this incident to IB Wave.

9.1.2 IB Wave will decide, in each case, the actions to be taken, formally notifying the adult responsible for the student of this incident.

9.2 The verbal manifestation of racist, xenophobic messages or messages advocating violence by the student or the responsible adult.

9.2.1 In the event that the student or their responsible adult verbally make racist or xenophobic statements or advocate violence in any of its forms, the tutor will ask the student, or the responsible adult to cease their statements. If such statements persist, the tutor must end the meeting and report this incident to IB Wave.

9.2.2 IB Wave will decide, in each case, the actions to be taken, formally notifying the adult responsible for the student of this incident.

9.3 Display from the student’s electronic device (Tablet, iPad, PC) of inappropriate or illegal images.

9.3.1 If the tutor, through the screen of their electronic device, witnesses the display of pornographic images, images of child abuse, indecent images of a minor or violent, racist or xenophobic images originating in bad faith on the device of the student, they must end the meeting and report this serious incident immediately to IB Wave.

9.3.2 As soon as possible, IB Wave will review the recording of the meeting, proceed to safeguard it and make it available to the competent authorities.

9.3.3 IB Wave will report this serious incident to the adult responsible for the student, also making them participate in any legal actions that may arise.

9.4 Reception of sensitive, non-educational or academic information

9.4.1 If a student reveals sensitive information of an economic, medical or family nature, or simply information of a non-educational or academic nature, the tutor must determine the impact of said information and whether the incident should lead to the cancellation of the telematic meeting and its notification to IB Wave. It is important to underline that the disclosure of sensitive information related to the physical or emotional safety of the student should always be notified to IB Wave.

9.5 A proposal for action that exceeds the strictly educational relationship with the student.

9.5.1 In the event that the tutor receives, from the student or their responsible adult, a proposal for action, of any kind, that exceeds the educational relationship that both maintain, they must end the telematic meeting and notify IB Wave.

9.5.2 Once notification of the incident has been received from the tutor, IB Wave will ask the adult responsible for the student for their version of what happened and will decide, in each case, the actions to be taken.

 

If the Student is subjected to: 

10.1. Inappropriate or abusive language or gestural behaviour in the lesson by the tutor.

10.1.1 In the event that the tutor uses inappropriate or abusive language or gesture behaviour, the student will ask the tutor to avoid the use of such language or behaviour during class. If such language or behaviour persists, the student must leave the telematics meeting and report this incident to their responsible adult or, if this is not possible, directly to IB Wave.

10.1.2 Once notification of the incident has been received from the student or their responsible adult, IB Wave will ask the tutor for their version of what happened and will decide, in each case, the actions to be taken.

10.2 The verbal manifestation of racist, xenophobic messages or messages advocating violence by the tutor.

10.2.1 In the event that the tutor verbally makes racist or xenophobic statements or advocates violence in any of its forms, the student will ask the tutor to cease their statements. If said statements persist, the student must leave the telematics meeting and report this incident to their responsible adult or, if this is not possible, directly to IB Wave.

10.2.2 Once notification of the incident has been received from the student or their responsible adult, IB Wave will review the recording  of the meeting, will ask the tutor for their version of what happened and will decide, in each case, the actions to be taken.

10.3 Display from the tutor’s electronic device (Tablet, iPad, PC) of inappropriate images.

10.3.1 If the student, through the screen of their electronic device, witnesses the display of pornographic images, images of child abuse, indecent images of a minor or violent, racist or xenophobic images originating on the device of the student, they must end the meeting  and report this serious incident immediately to their responsible adult.

10.3.2 The responsible adult will formally notify IB Wave of this serious incident as accurately and in detail as possible.

10.3.2 As soon as possible, IB Wave will review the recording of the meeting, proceed to safeguard it and make it available to the competent authorities.

10.3.4 IB Wave will compare what happened with the tutor and, where appropriate, will proceed to terminate all types of professional relationship.

10.3.5 IB Wave, based on the seriousness of the facts, may initiate legal action against the tutor, which will be duly communicated to the adult responsible for the student.

10.4 A proposal for action outside of the strictly educational relationship with the tutor.

10.4.1 In the event that the student receives, from the tutor, a proposal for action, of any kind, that exceeds the strictly educational relationship that both maintain, the student must leave the telematic meeting and report this incident to their responsible adult or, if this is not possible, directly to IB Wave.

10.4.2 Once notification of the incident has been received from the student or their responsible adult, IB Wave will ask the tutor for their version of what happened and will decide, in each case, the actions to be taken.
